Agreement

1. By using Gemsta.com you are agreeing to use these Terms and Conditions. If you do not agree to these Terms and Conditions, then please refrain from using this website.  Please note that we reserve the right to update these Terms and Conditions from time to time, and therefore your continued use of Gemsta constitutes your acceptance of any new Gemsta Terms and Conditions.

2. You agree to use Gemsta only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of Gemsta by any third party. Such restrictions or inhibitions include, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, and the transmission of obscene or offensive content or disruption to the normal flow of dialogue within this website.

3. Gemsta Limited is a limited company registered in England and Wales, with registration number 06374577, and whose registered office is at 5 The Triangle, Wildwood Drive, Worcester, Worcestershire, WR5 2QX.

4. Gemsta will use its reasonable endeavours to maintain Gemsta.com in a fully operating condition.  Gemsta is not responsible for the results of any defects that exist in the Gemsta website. You should not assume that Gemsta or its content is error free or that it will be suitable for the particular purposes that you have in mind when using it.   Gemsta reserves the right to make subsequent changes to it and services may be modified, supplemented or withdrawn. 

Information we collect from you

5. In general you can visit Gemsta without telling us who you are or revealing any information about yourself.  However, there are parts of the Gemsta website where we may need to collect some basic information about you to personalise your settings (including your email address, gender and which age range you fall in to).  This information will not be enough to enable us to identify you and you do not have to supply it if you do not wish to do so.

6. Our Privacy Policy explains how we protect and respect the data that we collect from you. Your use of Gemsta constitutes your acceptance of this policy. 

Links to Third Party Websites

7. Gemsta provides links to third party websites as part of our service. We accept no liability for any statements, information, content, products or services that are published on, or may be accessible from, these third party websites.     By providing a link to a third party website, Gemsta is in no way endorsing the service that it provides.    We also give no guarantee that the link will work at all times, and that the third party website is free from any virus or anything else that could be damaging to your computer or the information held on it.  Gemsta accepts no liability for any loss or damage that you may incur as a result of accessing such a third party website.

Accessing Gemsta

8. Whilst there is no minimum age requirement to use Gemsta it should be noted that it is possible to access third party websites by using the various search functions available on Gemsta.  Accordingly all parents and responsible adults must ensure that any children in their care are adequately supervised whilst using Gemsta.   Access to Gemsta is permitted on a temporary  basis, and we reserve the right to withdraw or amend the service that we provide on our website without notice.   We will not be liable if for any reason our website is unavailable for any period of time.

We are the owners or licensees of all intellectual property rights in Gemsta (registered or unregistered) and any material published on it.  This includes, inter alia, all trademarks, logos, design rights, copyright, database rights, business names, trading names and any other intellectual property rights (registered or unregistered) in Gemsta.    Requests for permission to use the Gemsta logo or name should be directed to our (media and communications team) on 01905 362120 or to gemsta@primeplc.com

10. You must not copy, reproduce, republish, download, post, broadcast, transmit, distribute, store or otherwise use the material on the Gemsta website or the website itself: (a) for any commercial purpose; (b) for incorporation in any other work or material whether in hard copy or electronic or any other form; (c) to make them appear part of any third party’s website or electronic database or retrieval system; or (d) in any other way except for viewing, printing or saving a back-up copy to your local hard disk for your own personal, non-commercial use.

Viruses and Hacking

11. You must not misuse Gemsta by knowingly introducing any virus, Trojan, worm or other material which is damaging or harmful in any way.      You must not attempt to gain unauthorised access to the Gemsta website, the server on which our website is hosted or any server, computer or data base connected to Gemsta. We will report any breach or attempted breach of this provision to the relevant authority, and in the event of any such action occurring your right to use Gemsta will cease immediately.

General

12. If any part of these Terms and Conditions are found to be illegal or unenforceable, this will not affect the validity or enforceability of the remainder of these terms.

13. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.  Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

14. We may suspend or vary the whole or any part of the service offered by Gemsta for any reason, at any time at our sole discretion without liability to you.

15. Gemsta reserves the right to vary these Terms and Conditions from time to time, such variations becoming effective immediately upon them being posted on Gemsta.net. By continuing to use Gemsta.co.uk you will be deemed to accept such variation.

16. Gemsta does not accept responsibility for any defects that may exist or for any costs, losses (including consequential loss) arising from your use of, or inability to use or access or a failure, suspension or withdrawal of all or part of the Gemsta website at any time.   

17. Gemsta does not give any guarantee that the content of the Gemsta website is free from viruses or anything else that has contaminating or destructive properties including where such viruses or other programmes result in loss of or corruption to your data or other property. 

18. Gemsta excludes all liability whether in contract, tort or otherwise for the accuracy, suitability, quality or completeness of any information and the value and integrity of goods and services offered by third parties over Gemsta.co.uk.  You acknowledge that we have no control over and we exclude all liability for any material on the World Wide Web which can be accessed using Gemsta. 

19. Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy.
